We facilitate the transfer of Gifts through third-party payment processors but do not directly handle or store user funds.

2. Eligibility

You must be at least 18 years old and capable of forming a binding legal agreement to use our Service. By creating an account, you represent that all information you provide is accurate, complete, and current.

3. Accounts

• To host an event, you must create a user account.
• You are responsible for maintaining the confidentiality of your login credentials and all activity under your account.
• We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, abusive, or illegal behavior.

4. Payment Processing

• Payments made through Gild Gifting are processed by trusted third-party payment processors (such as Stripe).
• By sending or receiving Gifts, you agree to comply with the payment processor's terms and conditions.
• Gild Gifting does not store or have access to full payment information such as credit card or bank account details.
• We may charge transaction or service fees, which will be clearly disclosed prior to payment.
• Hosts are responsible for any taxes that may apply to funds received.

5. Refunds and Disputes

• Gifts sent through Gild Gifting are generally non-refundable.
• If a payment error occurs, users should contact both Gild Gifting support and the payment processor for assistance.
• We reserve the right to review and resolve disputes at our discretion but are not obligated to mediate between users.

6. Prohibited Activities

When using our Service, you agree not to:

• Use the platform for illegal or fraudulent purposes
• Misrepresent your identity or event details
• Solicit funds for purposes unrelated to legitimate events
• Attempt to hack, disrupt, or harm the Site or another user's experience
• Use bots, scripts, or automated systems to interact with the Service

7. Third-Party Links

• Our Site may contain links to third-party websites or services that are not owned or controlled by Gild Gifting.
• We are not responsible for the content, policies, or practices of these third-party sites.

11. Indemnification

You agree to defend, indemnify, and hold harmless Gild Gifting LLC, its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorney's fees) arising out of or related to:

Our total liability to any user shall not exceed the total amount of service fees paid to Gild Gifting within the past twelve (12) months.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any disputes shall be resolved exclusively in the state or federal courts located in Albany County, New York.
